Agreement to these terms

This website and online store are operated by Kolekar Healthcare & Exim LLP under the Wellera brand. By accessing the website, creating an account, placing an order or using our services, you agree to these Terms & Conditions, our Privacy Policy, Shipping Policy and Return & Refund Policy.

If you do not agree, please do not use the website or place an order. We may update these terms from time to time; continued use after an update means the revised terms will apply to future use and purchases.

Who may use the website

You must be at least 18 years old and legally capable of entering a binding contract under Indian law. If you use the website for another person or organisation, you confirm that you have authority to act for them.

You are responsible for providing accurate, current and complete account, billing and delivery information and for keeping your login credentials confidential.

Product descriptions and responsible use

We make reasonable efforts to present product descriptions, ingredients, images, directions, packaging, colour and quantity accurately. Screens and photography may display colours differently, and packaging may be updated without materially changing the product.

• Read the complete product label, ingredients, directions and warnings before use.
• Do not exceed the recommended usage stated on the approved product label.
• Consult a qualified healthcare professional if you are pregnant, breastfeeding, taking medication, have a medical condition, are scheduled for surgery, or have ingredient sensitivities.
• Stop use and seek appropriate advice if you experience an adverse reaction.
• Keep products away from children and store them as directed on the label.

Order acceptance, availability and cancellation

Submitting an order is an offer to purchase. An automated confirmation only acknowledges receipt; an order is accepted when we confirm processing or dispatch. We may limit quantities, reject or cancel an order where a product is unavailable, pricing or listing information is incorrect, payment fails, fraud is suspected, delivery is not serviceable, or applicable law requires it.

If we cancel a prepaid order, the eligible amount will be returned to the original payment method. You may request cancellation or an address change before packing or dispatch, but changes cannot be guaranteed once fulfilment begins.

Prices, promotions and payments

We may correct genuine pricing or listing errors. If an error affects your confirmed order, we will notify you and offer an appropriate resolution, which may include cancellation and refund.

Delivery estimates and customer responsibility

Dispatch and delivery dates are estimates, not guarantees. Delays may occur due to courier operations, weather, public holidays, address issues, force majeure events or circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and being available to receive the parcel. Risk and responsibility for the product pass as permitted by applicable law upon successful delivery. Please inspect the parcel and report damage, tampering, missing items or an incorrect product within 48 hours.

Returns, replacements and refunds

Returns and refunds are governed by our Return & Refund Policy. Because Wellera products are ingestible wellness products, opened, used, consumed or improperly stored products generally cannot be returned for hygiene and safety reasons.

Eligible cases may include a damaged, tampered, expired, missing or incorrect product reported within the specified period with the required photographs, order details and unboxing evidence. Approved refunds are generally returned to the original payment method, subject to banking or payment-provider timelines.

Using the website responsibly

You agree not to misuse the website or interfere with its normal operation. You must not:

• Use the website for unlawful, fraudulent, misleading or abusive purposes.
• Attempt unauthorised access, introduce malware, scrape protected content or disrupt security.
• Copy, reproduce, republish or commercially exploit website content without permission.
• Submit false reviews, impersonate another person or provide inaccurate order information.
• Use automated tools to overload, manipulate or unfairly access the website or offers.

We may restrict or suspend access where reasonably necessary to protect customers, the website, our rights or legal compliance.

Brand and content ownership

The Wellera name, logos, packaging, product artwork, photographs, graphics, text, layout and other website materials are owned by or licensed to us and are protected by applicable intellectual-property laws. No licence is granted except the limited right to use the website for personal, lawful and non-commercial purposes.

Content you submit

You remain responsible for reviews, feedback, images or other content you submit. You confirm that your submission is truthful, lawful, does not violate another person’s rights and does not contain confidential, defamatory or harmful material.

Where permitted by law, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce and display voluntarily submitted reviews or feedback for operating, improving and promoting Wellera. We may moderate or remove content that violates these terms.

External links and service providers

The website may connect to payment gateways, couriers, marketplaces, social platforms or other third-party services. Those services operate under their own terms and policies. We are not responsible for third-party websites, content or interruptions beyond the extent required by applicable law.

Reasonable limits

We aim to keep the website accurate, secure and available, but do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, Wellera is not liable for indirect, incidental, special or consequential loss arising from website use, third-party services, misuse of products or failure to follow label directions.

Nothing in these terms excludes or limits rights, remedies or liability that cannot lawfully be excluded, including applicable consumer rights. Any liability that may lawfully be limited will be limited to the extent permitted under applicable law.

Your responsibility for misuse

To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful misuse of the website, violation of these terms, infringement of third-party rights or fraudulent activity.

Events outside reasonable control

We will not be responsible for delay or failure caused by circumstances beyond reasonable control, including natural events, epidemic or pandemic disruption, strikes, transport interruption, internet or power failure, government action, supply disruption or courier delays. We will take reasonable steps to communicate and reduce the impact where practical.

Law, disputes and jurisdiction

These terms are governed by the laws of India. We encourage you to contact us first so we can try to resolve any concern fairly. Subject to mandatory consumer-protection rights and applicable jurisdiction rules, disputes will be subject to the competent courts in Pune, Maharashtra.
